Terms of Use for New Zealand Players

Version of 21 September 2026. We date this agreement instead of editing it quietly, so you can always tell whether the terms you accepted are the terms on this screen.

1. Who we are and what this covers

Smokos Casino operates from outside New Zealand and holds no New Zealand gambling licence; the Department of Internal Affairs does not license or supervise us. Under the Gambling Act 2003 it stays lawful for a person here to play at a casino based overseas, and that is the footing this agreement sits on.

Smokos Casino operates from outside New Zealand. We hold no New Zealand gambling licence and the Department of Internal Affairs neither licenses nor supervises us. Under the Gambling Act 2003 it remains lawful for a person in New Zealand to play at an overseas casino.

These terms apply the moment you open an account with us and continue to apply until it is closed. By registering you confirm that you have read them, that you are entering the agreement on your own behalf, and that you are doing so from a country where it is lawful for you to do it.

2. Eligibility

  • You must be at least 18 years old. We verify age and an account belonging to anyone younger is closed with the balance returned to source.
  • One account per person, per household, per device and per payment method. Duplicates are closed and bonus winnings on them are forfeited; your own deposited funds are always returned.
  • You must not be resident in a jurisdiction we do not accept. The register of those is inside the cashier and is kept current.
  • You must not be acting for anyone else, or funding the account with money that is not yours.

3. Your account

You are responsible for the password and for anything done through your account while it is logged in. Tell us immediately if you think someone else has access, and switch on two-factor authentication before you need it rather than afterwards.

Register in your legal name. It has to match your identification and the name on the account you withdraw to; a mismatch stops a withdrawal until it is resolved, and resolving it is slower than getting it right at registration.

4. Deposits

  • The minimum deposit is NZ$20.
  • Your account is held in NZD. We add no fee on either leg. Your own bank or wallet may charge you and that charge is not ours to waive.
  • We accept only payment methods held in your own name.
  • A deposit limit set in your profile applies immediately when tightened and after twenty-four hours when loosened.

5. Withdrawals

The minimum withdrawal is NZ$30. Daily withdrawals are capped at NZ$8,000 and monthly at NZ$40,000; anything above is paid in instalments on the same schedule and does not need to be requested again.

Money returns to the method it arrived by, up to the amount deposited by that method, as the rules on money laundering require. Anything beyond that is paid to your bank account.

Typical times after verification: e-wallets under 10 minutes, cryptocurrency under 15 minutes, cards 1 to 3 hours, bank transfer 1 to 3 working days.

6. Verification

Before the first withdrawal we ask for photo identification, proof of address dated within three months, and an image of the payment method used. Most sets are cleared within 24 hours. We may repeat the check later if the account changes materially, and we may ask about the source of funds where the law requires it.

7. Bonuses

Bonus terms sit in a separate document, the Bonus Rules, and they form part of this agreement. Where the two documents differ on a bonus question, the Bonus Rules govern.

8. Fair play

The following end an account and forfeit bonus winnings: using software to play automatically, exploiting a fault in a game rather than reporting it, colluding with another player at a live table, or opening accounts to claim the same offer repeatedly. Funds you deposited yourself are returned in every case.

9. Games and faults

Games are supplied by third-party studios and run on their servers. If a round is interrupted by a fault, it is settled according to the studio’s record of it. Where a display error shows a result or a balance that the game did not actually produce, the game’s record governs and we will correct the account.

10. Closing an account

You may close your account at any time by asking in chat or by email. Withdraw your balance first. We may close an account by giving you notice, and we will pay out any balance that is properly yours when we do.

11. Complaints

Raise it in live chat and ask for a ticket number. If the reply does not settle the matter, ask for escalation and a manager reviews the file within five working days. Because we are offshore, there is no New Zealand regulator above that step, which is why we keep it short and keep a record of it.

12. Changes

We may change these terms. Material changes are notified in your account before they take effect, and the version date at the top of this page always tells you which text is current. Continuing to use the account after a change means you accept it.

Where to ask about a clause

Any clause here can be put in plain words on request. Write to [email protected] and we will explain what it means in practice before you rely on it.
